Jan. 22, 2024: Floyd Abrams, eminent First Amendment lawyer, files objection saying FCC can deny Fox license without infringing free speech
Floyd Abrams, who argued free speech cases at the Supreme Court 13 times. and is a lecturer at Columbia Law School filed an Informal Objection with FCC saying that “knowing and repeated distortion of information” about an election “is precisely what a broadcaster may not do and that the Commission may consider in determining whether license renewal is appropriate.” He added that Fox’s “willful decision to repeatedly broadcast false information about the election, as Judge Davis decided, provides ample basis” for the FCC to deny the license.
Abrams called Fox’s objections on the grounds of free speech “fanciful” and “not a basis for this Commission to abandon complying with its statutory obligation to determine if license renewal is appropriate.”
